Definitions

“Hash Sets” means a set of objects consisting of one or more of any of the following:
- MD5 (128-bit hash value)
- SHA-1 (160-bit hash value)
- SHA-256 (256-bit hash value).
“Membership Access Credentials” means password, security keys, tokens, non-public URLs and/or other credentials or authentication approaches such as IP address based filtering assigned to Customer by HashSets.com that is uniquely associated with Customer’s HashSets.com account.
“Membership Type” means access to the Services through free or paid subscriptions.
“Tryout Membership” means Free Sample Hash Sets Only (1,000 lines each) for purposes of determining if the Services are acceptable for your use.
“Single User Membership – One Month Access” means paid membership that grants one user the right to access the website for a period of one month and use the periodic releases of prebuilt MD5, SHA-1 and SHA-256 Hash Sets via electronic download in ZIP/CD/DVD format, and thereafter-continued lifetime use of the previously provided Hash Sets by the same Single User only. You are granted authorization to use the prebuilt Hash Sets on any number of machines as long as that same same user is the only user. Privately or publicly redistributing the contents of prebuilt hash sets in similar or dissimilar form, directly or indirectly in competition with Whitehat Computer Forensics LLC and HashSets.com is prohibited.
“Single User Membership – One Year Access” means paid membership that grants one user the right to access the website for a period of one year and use the periodic releases of prebuilt MD5, SHA-1 and SHA-256 Hash Sets via electronic download in ZIP/CD/DVD format, and thereafter-continued lifetime use of the previously provided Hash Sets by the same Single User only. You are granted authorization to use the prebuilt Hash Sets on any number of machines as long as that same same user is the only user. Privately or publicly redistributing the contents of prebuilt hash sets in similar or dissimilar form, directly or indirectly in competition with Whitehat Computer Forensics LLC and HashSets.com is prohibited.
“Multi User Office – One Year Access” means paid membership that grants more than one user within a single office (usually a building or portion of a building where a company conducts its business e.g. main office, home office, field or branch office) the right to access the website for a period of one year and use periodic releases of prebuilt MD5, SHA-1 and SHA-256 Hash Sets via electronic download in ZIP/CD/DVD format, and thereafter-continued lifetime use of the previously provided Hash Sets by the same single office users. You are granted to use the prebuilt Hash Sets on any number of machines as long as the users are within the same single office. Privately or publicly redistributing the contents of prebuilt hash sets in similar or dissimilar form, directly or indirectly in competition with Whitehat Computer Forensics LLC and HashSets.com is prohibited.
“Multi Offices – One Year Access” means paid membership that grants more than one user within multiple offices (usually buildings or portion of buildings where a company conducts its business e.g. main offices, home offices, field or branch offices) the right to access the website for a period of one year and use periodic releases of prebuilt MD5, SHA1 and SHA256 Hash Sets via electronic download in ZIP/CD/DVD format, and thereafter-continued lifetime use of the previously provided Hash Sets by the multiple office users. You are granted to use the prebuilt Hash Sets on any number of machines as long as the users are within the same multi offices. Privately or publicly redistributing the contents of prebuilt hash sets in similar or dissimilar form, directly or indirectly in competition with Whitehat Computer Forensics LLC and HashSets.com is prohibited.
“Bronze Service – One Year Access” means paid membership that grants one user the right to access the website for a period of one year and use the periodic releases of prebuilt MD5, SHA-1 and SHA-256 Hash Sets via electronic download in ZIP/CD/DVD format for your third-party product and/or software redistribution use only (privately or publicly redistributing the contents of prebuilt hash sets in similar or dissimilar form, directly or indirectly in competition with Whitehat Computer Forensics LLC and HashSets.com is prohibited). Thereafter-continued lifetime use of the previously provided Hash Sets for the same approved purposes.
“Platinum Service – One Year Access” means paid membership that includes access to periodic releases of prebuilt MD5, SHA-1 and SHA-256 Hash Sets via electronic download in ZIP/CD/DVD format, PLUS continuous releases of the newest ‘The Hash Search Engine Database Dumps’ (includes tab delimited table exports and SQL, MySQL, Oracle and PostgreSQL import table script templates), optional use of the aforementioned for research and development purposes, third-party product and/or software redistribution use only. Privately or publicly redistributing the contents of the database tables and/or prebuilt Hash Sets in similar or dissimilar form, directly or indirectly in competition with Whitehat Computer Forensics LLC and HashSets.com is prohibited. After the one-year access you are granted continued lifetime use of the previously provided hash sets and database dumps for the same previously approved purposes.
“Lifetime Subscription” means a one time paid membership that includes perpetual access to current and future releases of prebuilt MD5, SHA-1 and SHA-256 Hash Sets via electronic download in ZIP/CD/DVD format, PLUS continuous releases of the newest ‘The Hash Search Engine Database Dumps’ (includes tab delimited table exports and SQL, MySQL, Oracle and PostgreSQL import table script templates), optional use of the aforementioned for research and development purposes, third-party product and/or software redistribution use only. Privately or publicly redistributing the contents of the database tables and/or prebuilt Hash Sets in similar or dissimilar form, directly or indirectly in competition with Whitehat Computer Forensics LLC and HashSets.com is prohibited. The perpetual access remains valid as long as Whitehat Computer Forensics LLC and HashSets.com offers hash sets and Whitehat Computer Forensics LLC and HashSets.com continues to remain in business. Whitehat Computer Forensics LLC and HashSets.com reserves the right to discontinue updates or support for hash sets at its discretion due to technological changes, third-party dependencies and Whitehat Computer Forensics LLC and HashSets.com continues to make hash sets available. You are also granted continued lifetime use of the previously provided hash sets and database dumps for the same previously approved purposes.
“Affiliate” means any entity that directly or indirectly controls, is controlled by, or is under common control with such party.
“Confidential Information” means information disclosed by a party to the other party under this agreement that is marked as confidential or would normally be considered confidential under the circumstances.
“Customer Implementation” means an internal or external software applications or websites that incorporates the Services.
“Documentation” means the HashSets.com proprietary documentation in the form generally made available by HashSets.com to its customers for use with the Services.
“Fees” means the applicable fees for Customer’s plan level set forth on the HashSets.com website (https://www.hashsets.com/) and any applicable Taxes.
“Intellectual Property Rights” means current and future worldwide rights under patent law, copyright law, trade secret law, trademark law, moral rights law, and other similar rights.
“License Term” means the period of time during which Customer is authorized to use the Services. The Licensed Term is monthly unless agreed otherwise in a custom Services plan.
“Services” means the HashSets.com service, and your use of the MD5, SHA-1, SHA-256 hash values.
“Start Date” means the date upon which HashSets.com provides Customer the Membership access for the Services.
“Taxes” means any duties, customs fees, or taxes (other than HashSets.com’s income tax) associated with the sale of the Services, including any related penalties or interest.
“Term” means the term of the Agreement, which will begin on the Start Date and continue until the earlier of: (i) the end of the last License Term or (ii) the Agreement is terminated as set forth herein.
“The Hash Search Engine” means our online searchable database(s) containing MD5, SHA-1, SHA-256 hash values and various associated file metadata from files we have analyzed since 2003.
“The Hash Search Engine Database Dumps” means an export or snapshot of the data and structure (schema) of our hash sets database(s) including tables, saved in tab delimited .txt files, that are made readily available for download from the HashSets.com website.
